The law indicates the minimum conditions of the special contract for formative practice, such as i) Monthly remuneration not less than three current legal monthly minimum wages as educational support, ii) Guarantee of the conditions, means, and resources required for formative development, iii) Affiliation to health and occupational risk systems, iv) Right to paid leave for the period that the higher education institution contemplates for the program, without exceeding 15 business days per academic year, without prejudice to the special cases established in the regulation, v) Work or practice plan specific to the training program, according to the characteristics of the services, within the spaces and schedules that the health service provider institution has contemplated, vi) Work less than 12 hours per shift and 66 hours per week, except in emergency cases, among other conditions.
Law 1917 of 2018 creates a new special form of contracting within the framework of the teaching-service relationship, consisting of a formative practice contract for the resident, whereby the resident is obligated to provide, for the duration of the academic program, a personal service in accordance with the plan of progressive delegation of competencies specific to the specialization.
Likewise, this law creates the National Fund for Medical Residencies, which will be financed by: i) resources from the national budget, ii) contributions from the IPS where residents carry out their practices, and iii) other public sources, such as those allocated to finance the credit scholarship program.
Finally, it is important to emphasize that this law establishes a maximum period of one year for the Ministry of Health to regulate the provisions set forth in this new regulation.
